Mit dieser Datenschutzerklärung informieren wir Sie über Art, Umfang und Zweck der Verarbeitung personenbezogener Daten (nachfolgend „Daten") im Rahmen unserer Website. Für alle verwendeten Begriffe, wie z. B. „Verarbeitung" oder „Verantwortlicher", verweisen wir auf die Definitionen des Art. 4 der Datenschutz-Grundverordnung (DSGVO).

Werden Daten zum Zweck der Direktwerbung verarbeitet, haben Sie das Recht, jederzeit ohne Angabe von Gründen Widerspruch einzulegen.

Beschwerderecht: Sie haben das Recht, sich bei einer Datenschutz-Aufsichtsbehörde zu beschweren (Art. 77 DSGVO). Da wir keine Niederlassung in der EU unterhalten, können Sie sich an die Aufsichtsbehörde Ihres gewöhnlichen Aufenthaltsortes oder an die für unsere europäische Kontaktstelle zuständige Behörde wenden:

4. Aufruf der Website, Server-Logfiles und Hosting

Diese Website wird bei der IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Deutschland, gehostet. Die Server befinden sich in Deutschland. Mit IONOS besteht ein Vertrag zur Auftragsverarbeitung nach Art. 28 DSGVO.

Bei jedem Aufruf der Website erhebt und speichert der Hostingdienstleister automatisch Informationen in sogenannten Server-Logfiles, die Ihr Browser übermittelt. Dies sind:

• anonymisierte bzw. gekürzte IP-Adresse des anfragenden Rechners,
• Datum und Uhrzeit des Zugriffs,
• Name und URL der abgerufenen Datei,
• übertragene Datenmenge, Meldung über erfolgreichen Abruf,
• verwendeter Browsertyp und -version, Betriebssystem,
• Referrer-URL (die zuvor besuchte Seite).

Die Verarbeitung erfolgt zur Gewährleistung eines störungsfreien Betriebs, der Sicherheit und der Optimierung der Website. Rechtsgrundlage ist unser berechtigtes Interesse an diesen Zwecken gemäß Art. 6 Abs. 1 lit. f DSGVO. Die Logfiles werden aus Sicherheitsgründen für die Dauer von 7 Tagen gespeichert und anschließend gelöscht, sofern nicht ein konkreter sicherheitsrelevanter Vorfall eine längere Aufbewahrung erforderlich macht.

5. Cookies und Einwilligungsverwaltung

Unsere Website verwendet Cookies und vergleichbare Speichertechnologien (z. B. localStorage). Cookies sind kleine Textdateien, die auf Ihrem Endgerät gespeichert werden.

• Technisch notwendige Cookies sind für den Betrieb der Website erforderlich (z. B. Speicherung Ihrer Cookie-Auswahl und Ihrer Sprachwahl). Rechtsgrundlage ist § 25 Abs. 2 Nr. 2 TDDDG sowie Art. 6 Abs. 1 lit. f DSGVO.
• Statistik- und Marketing-Cookies setzen wir nur mit Ihrer ausdrücklichen Einwilligung ein (§ 25 Abs. 1 TDDDG, Art. 6 Abs. 1 lit. a DSGVO). Ohne Einwilligung werden die entsprechenden Dienste nicht geladen.

Beim ersten Besuch werden Sie über einen Consent-Banner um Ihre Auswahl gebeten. Sie können Ihre Einstellungen jederzeit unter Cookie-Einstellungen aufrufen und mit Wirkung für die Zukunft ändern oder widerrufen. Der Widerruf berührt nicht die Rechtmäßigkeit der bis dahin erfolgten Verarbeitung.

6. Kontaktaufnahme (Kontaktformular und E-Mail)

Wenn Sie uns über das Kontaktformular oder per E-Mail kontaktieren, verarbeiten wir die von Ihnen mitgeteilten Daten (z. B. Anrede, Name, Unternehmen, E-Mail-Adresse, Telefonnummer, Inhalt Ihrer Nachricht sowie die Bestätigung dieser Datenschutzerklärung), um Ihre Anfrage zu bearbeiten und zu beantworten.

Die über das Formular abgesendeten Angaben werden per E-Mail an ein bei IONOS gehostetes E-Mail-Postfach der OEM PARTS EXPRESS, Inc. übertragen und dort sowie in unserem Geschäftsbetrieb weiterverarbeitet.

Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, sofern Ihre Anfrage auf den Abschluss oder die Durchführung eines Vertrags gerichtet ist, im Übrigen unser berechtigtes Interesse an der Beantwortung von Anfragen gemäß Art. 6 Abs. 1 lit. f DSGVO.

Hinweis zur Datenübermittlung in ein Drittland: Verantwortlicher ist ein in der Volksrepublik China ansässiges Unternehmen. Ihre Anfrage und die damit verbundenen Daten werden daher zur Bearbeitung an unseren Standort in China übermittelt. Für die Volksrepublik China besteht kein Angemessenheitsbeschluss der Europäischen Kommission nach Art. 45 DSGVO. Die Übermittlung erfolgt, soweit sie für die Erfüllung eines Vertrags oder die Durchführung vorvertraglicher Maßnahmen auf Ihre Anfrage hin erforderlich ist, auf Grundlage von Art. 49 Abs. 1 lit. b DSGVO, im Übrigen auf Grundlage Ihrer ausdrücklichen Einwilligung nach Art. 49 Abs. 1 lit. a DSGVO, die Sie mit dem Absenden des Formulars und der Bestätigung dieses Hinweises erteilen. Es kann in diesem Zusammenhang nicht ausgeschlossen werden, dass staatliche Stellen in China auf die übermittelten Daten zugreifen und ein den EU-Standards entsprechendes Schutz- und Rechtsschutzniveau nicht in jedem Fall gewährleistet ist.

Wir speichern Ihre Anfrage, bis der jeweilige Vorgang abschließend bearbeitet ist und keine gesetzlichen Aufbewahrungspflichten entgegenstehen; handelsrechtlich relevante Korrespondenz wird bis zu 6 bzw. 10 Jahre aufbewahrt.

7. Schriftarten und externe Medien

Einzelne Seiten binden Schriftarten des Dienstes Google Fonts über Server der Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Irland) ein. Beim Aufruf wird dabei Ihre IP-Adresse an Google übertragen. Rechtsgrundlage ist unser berechtigtes Interesse an einer einheitlichen und ansprechenden Darstellung gemäß Art. 6 Abs. 1 lit. f DSGVO. Die Rechtsseiten (Impressum, Datenschutz, Cookie-Einstellungen, Code of Conduct) binden keine externen Schriften ein.

Die Startseite bindet Bild- und Videomaterial der Dienste Unsplash (Unsplash Inc., Kanada) und Pexels (Pexels GmbH, Deutschland / Canva) ein, das von deren Servern geladen wird; auch hierbei wird Ihre IP-Adresse an den jeweiligen Anbieter übertragen (Art. 6 Abs. 1 lit. f DSGVO).

8. Webanalyse: Google Analytics 4 und Google Tag Manager

Auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG) nutzen wir Google Analytics 4 und den Google Tag Manager, Dienste der Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland.

Der Google Tag Manager verwaltet das Einbinden weiterer Dienste (Tags); er erhebt selbst keine personenbezogenen Daten, ermöglicht aber das Auslösen anderer Tags, die ihrerseits Daten erfassen können. Google Analytics verwendet Cookies und ähnliche Kennungen, um Ihre Nutzung der Website auszuwerten (u. a. besuchte Seiten, Verweildauer, ungefährer Standort auf Grundlage der gekürzten IP-Adresse, Gerät und Browser). Diese Informationen werden zu pseudonymen Nutzungsprofilen zusammengefasst.

Dabei können Daten an die Google LLC in den USA übertragen werden. Google ist unter dem EU-US Data Privacy Framework zertifiziert; ergänzend hat Google Standardvertragsklauseln der EU-Kommission abgeschlossen. Die IP-Anonymisierung ist in Google Analytics 4 standardmäßig aktiviert. Speicherdauer der Cookies: bis zu 24 Monate; Aufbewahrung der Nutzerdaten auf Google-Ebene: bis zu 14 Monate.

9. Meta-Pixel (Facebook/Instagram)

Auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG) setzen wir das Meta-Pixel der Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland, ein. Damit können wir die Wirksamkeit von Werbeanzeigen auf Plattformen von Meta zu statistischen und Marktforschungszwecken auswerten und Besucherinnen und Besuchern unserer Website zielgerichtete Werbung anzeigen (Retargeting).

Hinsichtlich der Erhebung und Übermittlung der Daten an Meta sind wir und Meta gemeinsam Verantwortliche (Art. 26 DSGVO). 10. LinkedIn Insight Tag

Auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG) nutzen wir das LinkedIn Insight Tag der LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Irland. Es ermöglicht Statistiken über Besucherinnen und Besucher unserer Website sowie die Auswertung von Werbekampagnen auf LinkedIn. Dabei werden u. a. URL, Referrer-URL, IP-Adresse (gekürzt/gehasht), Geräte- und Browsereigenschaften sowie Zeitstempel verarbeitet.

11. Datenübermittlung in Drittländer

Wie in den vorstehenden Abschnitten beschrieben, werden Daten teilweise in Länder außerhalb des Europäischen Wirtschaftsraums übermittelt, insbesondere in die Volksrepublik China (Sitz des Verantwortlichen) und in die USA (eingesetzte Dienste). Erfolgt die Übermittlung nicht auf Grundlage eines Angemessenheitsbeschlusses, stützen wir sie auf geeignete Garantien (Standardvertragsklauseln der EU-Kommission), auf eine ausdrückliche Einwilligung oder auf die Erforderlichkeit zur Vertragserfüllung (Art. 44 ff. DSGVO). Auf Anfrage stellen wir Ihnen weitere Informationen zu den Garantien zur Verfügung.

12. Speicherdauer

Wir verarbeiten und speichern Ihre Daten nur so lange, wie es für die Erreichung des Verarbeitungszwecks erforderlich ist oder gesetzliche Aufbewahrungsfristen dies vorsehen (insbesondere handels- und steuerrechtliche Fristen von 6 bzw. 10 Jahren). Entfällt der Zweck oder läuft eine Frist ab, werden die Daten routinemäßig gelöscht oder gesperrt.

13. Datensicherheit

Diese Website nutzt eine SSL-/TLS-Verschlüsselung. Eine verschlüsselte Verbindung erkennen Sie an „https://" in der Adresszeile Ihres Browsers. Wir treffen im Übrigen geeignete technische und organisatorische Maßnahmen, um Ihre Daten gegen Manipulation, Verlust und unberechtigten Zugriff zu schützen.

4. Accessing the website, server log files and hosting

This website is hosted by IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. The servers are located in Germany. A data processing agreement pursuant to Article 28 GDPR is in place with IONOS.

Each time the website is accessed, the hosting provider automatically collects and stores information transmitted by your browser in so-called server log files:

• anonymised or shortened IP address of the requesting device,
• date and time of access,
• name and URL of the file retrieved,
• volume of data transferred, notification of successful retrieval,
• browser type and version, operating system,
• referrer URL (the previously visited page).

Processing serves to ensure smooth operation, security and optimisation of the website. The legal basis is our legitimate interest in these purposes pursuant to Article 6(1)(f) GDPR. For security reasons, the log files are stored for 7 days and then deleted, unless a specific security incident requires longer retention.

Our website uses cookies and comparable storage technologies (e.g. localStorage). Cookies are small text files stored on your device.

• Strictly necessary cookies are required to operate the website (e.g. storing your cookie choice and language selection). The legal basis is Section 25(2)(2) TDDDG and Article 6(1)(f) GDPR.
• Statistics and marketing cookies are only used with your explicit consent (Section 25(1) TDDDG, Article 6(1)(a) GDPR). Without consent, the relevant services are not loaded.

On your first visit you are asked for your choice via a consent banner. You can access your settings at any time under Cookie Settings and change or withdraw them with effect for the future. Withdrawal does not affect the lawfulness of processing carried out before it.

6. Contacting us (contact form and e-mail)

If you contact us via the contact form or by e-mail, we process the data you provide (e.g. salutation, name, company, e-mail address, telephone number, the content of your message and confirmation of this privacy policy) in order to handle and respond to your inquiry.

The details submitted via the form are transmitted by e-mail to an e-mail mailbox of OEM PARTS EXPRESS, Inc. hosted at IONOS and processed further there and within our business operations.

The legal basis is Article 6(1)(b) GDPR where your inquiry relates to the conclusion or performance of a contract, and otherwise our legitimate interest in responding to inquiries pursuant to Article 6(1)(f) GDPR.

Note on transfers to a third country: The controller is a company established in the People's Republic of China. Your inquiry and the associated data are therefore transferred to our site in China for processing. There is no adequacy decision by the European Commission for the People's Republic of China under Article 45 GDPR. To the extent that the transfer is necessary for the performance of a contract or the implementation of pre-contractual measures taken at your request, it is based on Article 49(1)(b) GDPR; otherwise it is based on your explicit consent pursuant to Article 49(1)(a) GDPR, which you give by submitting the form and confirming this note. In this context it cannot be ruled out that state authorities in China may access the transmitted data and that a level of protection and legal redress equivalent to EU standards is not guaranteed in every case.

We store your inquiry until the matter has been conclusively dealt with and no statutory retention obligations apply; correspondence relevant under commercial law is retained for up to 6 or 10 years.

7. Fonts and external media

Individual pages embed fonts from the Google Fonts service via servers of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). When a page is accessed, your IP address is transmitted to Google. The legal basis is our legitimate interest in a consistent and appealing presentation pursuant to Article 6(1)(f) GDPR. The legal pages (legal notice, privacy policy, cookie settings, code of conduct) do not embed any external fonts.

The home page embeds image and video material from the services Unsplash (Unsplash Inc., Canada) and Pexels (Pexels GmbH, Germany / Canva), loaded from their servers; your IP address is also transmitted to the respective provider in this case (Article 6(1)(f) GDPR).

8. Web analytics: Google Analytics 4 and Google Tag Manager

On the basis of your consent (Article 6(1)(a) GDPR, Section 25(1) TDDDG) we use Google Analytics 4 and Google Tag Manager, services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager manages the integration of further services (tags); it does not itself collect personal data but enables the triggering of other tags which may in turn collect data. Google Analytics uses cookies and similar identifiers to analyse your use of the website (including pages visited, time spent, approximate location based on the shortened IP address, device and browser). This information is aggregated into pseudonymous usage profiles.

Data may be transferred to Google LLC in the USA. Google is certified under the EU-US Data Privacy Framework; in addition, Google has concluded the European Commission's standard contractual clauses. IP anonymisation is enabled by default in Google Analytics 4. Cookie storage period: up to 24 months; retention of user data at Google level: up to 14 months.

9. Meta Pixel (Facebook/Instagram)

On the basis of your consent (Article 6(1)(a) GDPR, Section 25(1) TDDDG) we use the Meta Pixel of Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. This allows us to evaluate the effectiveness of advertisements on Meta platforms for statistical and market research purposes and to show targeted advertising to visitors of our website (retargeting).

With regard to the collection and transmission of data to Meta, we and Meta are joint controllers (Article 26 GDPR). Data may be transferred to Meta Platforms, Inc. in the USA (EU-US Data Privacy Framework, standard contractual clauses). Further information: facebook.com/privacy/policy. 10. LinkedIn Insight Tag

On the basis of your consent (Article 6(1)(a) GDPR, Section 25(1) TDDDG) we use the LinkedIn Insight Tag of LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland. It provides statistics about visitors to our website and enables the evaluation of advertising campaigns on LinkedIn. Among other things, URL, referrer URL, IP address (shortened/hashed), device and browser characteristics and timestamps are processed.

11. Transfers to third countries

As described in the sections above, data is in some cases transferred to countries outside the European Economic Area, in particular to the People's Republic of China (registered office of the controller) and to the USA (services used). Where the transfer is not based on an adequacy decision, we base it on appropriate safeguards (the European Commission's standard contractual clauses), on explicit consent, or on the necessity for the performance of a contract (Articles 44 et seq. GDPR). On request, we will provide you with further information on the safeguards.

12. Storage period

We process and store your data only for as long as is necessary to achieve the purpose of processing or as required by statutory retention periods (in particular commercial and tax law periods of 6 or 10 years). Once the purpose no longer applies or a period expires, the data is routinely deleted or blocked.

This website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser's address bar. We also take appropriate technical and organisational measures to protect your data against manipulation, loss and unauthorised access.

4. 访问网站、服务器日志与托管
